Terms of Service — Traction by Tightrope Studio

These Terms of Service ("Terms") govern your use of the website at https://tractionbytightropestudio.com and the Traction application (collectively, the "Service") operated by Traction by Tightrope Studio ("Traction," "we," "us," or "our").

Product evolution notice: Traction is an evolving software platform. Features, availability, and access levels may change as the product improves.

Acceptance of terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

What Traction provides

Traction is a guided revenue growth platform that helps users plan content, capture leads, follow up, track pipeline stages, understand performance, and receive recommended next actions from Orbit, our AI assistant.

Accounts and eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

Subscriptions, billing, and introductory pricing

Paid plans are billed on a recurring basis through our payment processor. Introductory pricing is offered as a limited promotional rate and may not be available after the introductory period ends. You may cancel at any time; cancellations take effect at the end of your current billing period unless otherwise stated. Taxes may apply.

Founding 50 — Price lock and seat reservation

The Founding 50 program is a limited pricing tier available to the first 50 paying members. The Service is live and fully supported; Founding 50 governs pricing and benefits only, not product availability or status.

The Founding 50 program is limited to the first fifty (50) paying members who activate a qualifying subscription at the applicable Founding 50 promotional rate ("Founding Rate"). Founding Rates are listed on the Pricing page and represent a discount off the standard public price for each tier. Founding 50 membership is non-transferable and tied to the individual account that completed checkout.

Founding 50 members receive the following price-lock guarantee: your Founding Rate will not increase for as long as your subscription remains active and in good standing. If your subscription lapses, is cancelled, or is terminated for any reason, the Founding Rate is permanently forfeited and cannot be reinstated.

Traction reserves the right to modify, extend, or close the Founding 50 program at any time without prior notice. Founding 50 status does not guarantee feature access beyond the plan tier purchased.

Token reservation — Affiliate and influencer program

This section applies to individuals or entities ("Influencers") who participate in Traction's affiliate or influencer program ("Program") and receive reserved access, promotional pricing, or complimentary subscription credits ("Reserved Tokens") in exchange for promotional activities.

Program enrollment

Participation in the Program requires a separate Influencer Agreement executed between the Influencer and Traction. These Terms govern general use of the Service; the Influencer Agreement governs the specific terms of compensation, deliverables, exclusivity, and content obligations. In the event of conflict, the Influencer Agreement controls.

Nature of Reserved Tokens

Reserved Tokens represent a conditional right to access the Service at no charge or at a reduced rate for a defined period. Reserved Tokens are:

Non-transferable and non-assignable
Tied to the Influencer's registered account
Revocable by Traction if the Influencer fails to fulfill the promotional obligations set forth in the Influencer Agreement
Not redeemable for cash, credit, or any other form of monetary compensation

Influencer obligations

In exchange for Reserved Tokens, Influencers agree to:

Promote the Service honestly and in accordance with all applicable FTC disclosure guidelines and platform-specific advertising policies
Disclose the existence of a material relationship with Traction in all promotional content (e.g., #ad, #partner, or equivalent)
Refrain from making false, misleading, or unsubstantiated claims about the Service, its features, or business outcomes
Not promote competing content scheduling, lead management, or AI-powered marketing platforms during any exclusivity period specified in the Influencer Agreement
Provide Traction with reasonable access to performance metrics (impressions, clicks, conversions) associated with promotional content upon request

Content rights

Influencers grant Traction a non-exclusive, royalty-free, worldwide license to repost, embed, or otherwise share Influencer-created promotional content that references Traction, provided such use is consistent with the Influencer Agreement. Traction will credit the Influencer where reasonably practicable.

Token forfeiture

Reserved Tokens are subject to immediate forfeiture, and any complimentary access will be terminated, if:

The Influencer materially breaches the Influencer Agreement and fails to cure the breach within 14 days of written notice
The Influencer publishes content that is defamatory, fraudulent, or materially harmful to Traction's reputation
The Influencer's account is terminated for violation of these Terms

Forfeiture of Reserved Tokens does not limit any other remedies available to Traction.

User content

You retain ownership of the content you create or upload to the Service ("User Content"). You grant Traction a limited license to host, store, process, and display your User Content solely to provide and improve the Service. You are responsible for ensuring you have the rights necessary to upload and use your User Content.

AI-generated content disclaimer

The Service includes AI-generated suggestions, drafts, captions, media, and recommendations. AI output may contain errors, inaccuracies, or inappropriate suggestions. You are responsible for reviewing AI output before publishing or relying on it. Traction does not guarantee the accuracy, suitability, or compliance of AI-generated content.

Connected accounts and third-party platforms

When you connect third-party platforms (such as LinkedIn, Meta/Facebook, Instagram, Google, Stripe, and email/newsletter tools), your use of those platforms remains subject to their own terms and policies. Traction is not responsible for the availability, content, or actions of third-party platforms.

Acceptable use

You agree not to use the Service to:

Violate any law or the rights of others
Send spam, scams, or deceptive communications
Upload harmful, infringing, or unlawful content
Attempt to disrupt, reverse engineer, or compromise the Service
Use the Service to harass, defame, or harm others
Misuse any connected platform in violation of its policies

No guarantee of business results

Traction provides tools and recommendations to support your marketing and sales efforts. We do not guarantee any specific business outcome, lead volume, revenue, conversion, ranking, or result. Outcomes depend on many factors outside our control.

Intellectual property

The Service, including its software, design, branding, and content (excluding User Content), is owned by Traction by Tightrope Studio or its licensors and is protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service except as expressly permitted.

Termination

We may suspend or terminate your access to the Service if you violate these Terms or use the Service in a way that creates risk for us or other users. You may stop using the Service at any time and request account deletion as described in our Privacy Policy.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACTION BY TIGHTROPE STUDIO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
